Complete Terms and Conditions

These terms and conditions are a contract between the ceremony couple and Cashman Professional, Inc. (dba The Hitchin’ Post Wedding Chapel). Paying a deposit or any monies is considered acceptance of these terms and conditions and accepting this contract in electronic format is the equivalent of signing a paper contract with Cashman Professional, Inc. Please read these terms and conditions carefully as all paid monies become non-refundable upon booking and are considered a Final Sale.

Marriage License Requirement
Couples renewing their marriage vows or requesting a non-legally binding commitment ceremony are not required to have a marriage license. If you choose to have your ceremony legally recognized, you must have a Nevada State Marriage License prior to your wedding and provide it at or before the time of your ceremony. Please see our MARRIAGE LICENSE page for more information. If you do not have your Nevada License available prior to the start of your scheduled ceremony time, you may opt to have a non-binding commitment ceremony for your invited guests and schedule and purchase a document signing (Make It Official package) at a later date and time, postpone the ceremony to the next available time and date, or cancel your ceremony. Officiants Fees
Wedding packages do not include a mandatory Officiant Fee of $60.00 USD to be paid directly to the Officiant in cash prior to your ceremony.  Celebrity Impersonator officiant fees are determined by the artist and disclosed prior to booking. There may also be an additional fee for an officiant to perform in a specified language other than English or Spanish. This fee covers the Officiant’s cost associated with performing your ceremony and filing the legal documents required in Clark County, NV. If your license was obtained in any county other than Clark County, an added fee of $10.00 is assessed to cover cost of certified mail. All Officiants provided by the Hitchin’ Post Wedding Chapel are licensed to perform weddings in the state of Nevada.

You may choose to provide your own officiant for a fee of $100.00 paid to the Hitchin’ Post Wedding Chapel. Your officiant must provide their original Nevada State Officiant License prior to the ceremony time and agree to allow us to photocopy this license for our records. Your officiant must also agree to keep the ceremony time no longer than 15 minutes to allow for photography (if included) and preparing the chapel for the next guest.

On-Time Arrival
At least one party of the ceremony couple should arrive at the Hitchin’ Post Wedding Chapel no less than 15 minutes prior to the scheduled ceremony start time to meet with the officiant and chapel staff, discuss the ceremony plan and pay any balances due. If included in your ceremony package, the bridal room will be available to you at this time. If the “couple” wishes to remain separate prior to the ceremony, please inform the Hitchin’ Post Wedding Chapel staff in advance so arrangements can be made. Please refer to our fee schedule below for fees related to late arrival.

Changes to Your Wedding Plan
Once you’ve paid your deposit to officially book your ceremony the Hitchin’ Post Wedding Chapel will hold your ceremony date and time exclusively for you. Changes to the date, time, or details of your ceremony including add-ons and package upgrades can be made and agreed to only by the ceremony couple. Please note, date and time changes may incur added fees. Package downgrades are not permitted less than 120 days before the reserved ceremony. Package upgrades are available at all times, schedule permitting.

Payment Policy and Schedule
Payment can be made by credit/debit card either through our online payment portal or in person at the Hitchin’ Post Wedding Chapel payment terminal. We also accept cash in U.S. currency only. We do not accept room charges, casino chips, or checks of any kind for payment.
Payment Schedule:

    • A deposit is required to reserve a ceremony date and time. Amount of deposit is dependent on package chosen.
    • The remaining balance for your package and add-ons chosen is due 5 days prior to your ceremony.
    • If you are reserving a date fewer than 5 days in the future, the full balance of your ceremony package and add-ons is due at the time of reservation.
    • You will have the opportunity for “same-day” add-ons immediately before your ceremony. Payment for these add-ons will be due at the time of purchase.
    • You will have the opportunity to purchase photo and/or video products after your ceremony. Payment will be due at the time of purchase

Fee Schedule
Reschedule fee: A reserved ceremony may be rescheduled one time at no cost provided the request to reschedule made no less than 30 days before the scheduled ceremony date and the new date requested is within one year of the original date. Subsequent rescheduling and/or reschedule requests made fewer than 30 days prior to the scheduled ceremony date will incur a fee of $75.00 USD. Rescheduling may be subject to other increased costs including on-peak and holiday rate increases if applicable. Same day rescheduling is not guaranteed.
Late fee: Late arrival by either party of ceremony couple requiring rescheduling will be subject to rescheduling fees and the ceremony will be rescheduled for the next available date and time.
Cancellation fee: Booking deposits are not refundable, though additional payments towards packages, add-ons or other fees are available for refund provided the ceremony is cancelled in writing at least 30 days prior to the scheduled date. If cancellation occurs fewer than 30 days prior to the scheduled ceremony date, no refunds will be issued.

Photography, video, and copyrights
The Hitchin’ Post Wedding Chapel provides professional photography and video for all chapel ceremonies. Photo and video capture by guests or hired persons is not permitted inside the Hitchin’ Post Wedding Chapel without purchase of a Guest Photo Pass, or Full Photo Pass. Cashman Professional, Inc. retains all copyrights to all photo and video images captured at the Hitchin’ Post Wedding Chapel. The “couple” hereby grants Cashman Professional, Inc. and its legal representatives, assigns, and those acting on its behalf, to use the photograph(s) and/or video file(s) captured on their behalf and bearing their likeness for all manner of advertising, trade, promotion, exhibition, or any other lawful purpose whatsoever and in any form. “Couple” shall have no right of approval, no claim to compensation, and no claim (including without limitation, claims based upon invasion of privacy, defamation, or right of publicity) arising out of any use, alteration, blurring, distortion, faulty reproduction, illusionary effect, or other use in any composite form of your name, picture, likeness, voice, and biographical information. Individual images, individual image copyrights, and the copyrights in their entirety (with some limitations) are available for purchase. Unless otherwise indicated all images sold individually do not include copyrights. Cashman Professional, Inc. and the Hitchin’ Post Wedding Chapel retain the right to use any images, even those sold with copyrights, for promotional purposes.

Custom Floral
Final payment and confirmation of custom fresh floral orders including bouquets, boutonnieres, flower girl baskets, corsages, and chapel décor is due 5 days prior to the scheduled ceremony date. This payment is non-refundable, nor can the order be changed after confirmation.

Arbitration of Disputes
In the event there are any disputes or controversies that arise between the parties pursuant to the terms of the aforesaid Contract and Services, then the parties are waiving their right to litigate these issues in court and instead elect to have these disputes resolved through arbitration. The parties agree that any disputes are to be arbitrated through the American Arbitration Association and that the parties agree to abide by the rules of the Commercial Arbitration Rules of the American Arbitration Association. WHEREFORE, it is agreed that all claims and disputes arising or relating to the Contract or Services are to be settled by binding arbitration in the State of Nevada. Said arbitration is to be resolved through the Commercial Arbitration Rules of the American Arbitration Association and the parties agree to abide by these rules. Any decision or award as a result of any such arbitration shall be issued in writing and the arbitrator shall be mutually selected pursuant to the Commercial Arbitration Rules of the American Arbitration Association. Any arbitration award may be confirmed in a court of competent jurisdiction.

Class Action Waiver
Any claim must be brought in the respective part’s individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, multiple plaintiffs, or similar proceeding (“Class Action”). The parties expressly waive any ability to maintain any Class Action in any forum.

Limitation of Liability
Provider’s liability to the Client under this Agreement is limited to the amount payable by Client to Provider for the relevant Order. Neither Client nor Provider will be liable for lost revenues or profits, downtime costs, loss or damage to data, or indirect, special, or consequential costs or damages. Provider is not responsible for ANY INCIDENTAL, DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR OTHER DAMAGES, INCLUDING LOSS OF REVENUE OR INCOME, PAIN, AND SUFFERING, EMOTIONAL DISTRESS, OR SIMILAR DAMAGES.

Data Security
To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online. Please review our Privacy Policy on our website.

Confidentiality
Customer represents and agrees that the terms and amount of this Agreement are considered confidential and will not be communicated to any third party.

Non-Disparagement
​Ceremony Couple agrees not to make any statements, written or verbal, or cause or encourage others to make any statements, written or verbal, that defame, disparage, or in any way criticize or cast in a negative light the personal or business reputation, practices, or conduct of the Company or its affiliated companies or any of their officers, agents, directors, supervisors, employees, or representatives. Ceremony Couple acknowledges and agrees that this prohibition extends to statements, written or verbal, made to anyone, including but not limited to, the news media, investors, potential investors, any board of directors or advisory board, or directors, industry analysts, competitors, strategic partners, vendors, representatives, potential customers, and clients, whether or not any such statement would be privileged. Furthermore, Ceremony Couple acknowledges and agrees that pursuant to this prohibition he/she will not provide, create, or assist in the creation of any disparaging content or statements regarding Company to any internet source, website, forum, message board, or the like, regardless of whether or not any of the Parties owns or operates any such source or website. Ceremony Couple are always encouraged to contact the Hitchin’ Post Wedding Chapel management for assistance to resolve any service issues.

General
Cashman Professional, Inc. (dba the Hitchin’ Post Wedding Chapel) is not responsible or liable for any items left in or around the Chapel and the surrounding grounds or vehicles, and any damage to property or vehicles. Cashman Professional, Inc. is not responsible nor liable for fire, flood, vandalism, lost mail, or any accident that may arise. Cashman Professional, Inc. is not responsible nor liable for any damaged or lost marriage licenses, photos, videos, or storage devices. These terms of service are subject to change without any prior notification. Anything not listed in the terms of service is open to interpretation and change by Cashman Professional, Inc. without prior notice. Lastly, we reserve the right to refuse service to anyone for any reason. These Terms and Conditions are Non-Negotiable and Final.
